Update term time claim – January 2020


Last week, UNISON’s National Education Officer and Legal Officers, together with the Regional Lead Officer for Education gave a presentation on the legal and practical issues involved in running term time cases.

The St Helens term time claim was discussed in depth and the next steps in utilising the full force of the legal system, if talks with the Council continue to make no progress.

The issue is simple, the employers have miscalculated annual leave entitlement and pay for term time workers. Why? Because the pro-rated calculation was incorrect to our members detriment. Whilst the amounts appear small per year, nevertheless the money belongs in your pockets and must be corrected going forward.

UNISON’s intention is that we ensure you receive a fair formula, with no less favorable treatment.

If the Council do not resolve this matter, we will be arguing in Tribunal that you have been discriminated against because of your part-time status and that you have received less than you should under the law/your contract. We are also reviewing the prospect of a case for discrimination; something St Helens Council is not unfamiliar with! The data collected from you indicates that 98% of you are female and 2% male.
